#WhatsNext Story & Pledge Consent Form

Your story is powerful. Your voice is needed.
The Society for Canadian Women in Science and Technology (SCWIST) invites individuals in science, technology, engineering, and mathematics (STEM) to share their stories, experiences, or pledges as part of our #WhatsNext campaign to end gender-based violence in STEM spaces.
This agreement is a binding contract between me and SCWIST for good and valuable consideration, including the opportunity I gain to submit my Content, the receipt and sufficiency of which are hereby acknowledged.
By submitting my Content, I hereby agree to the following:
1. Consent and Authorization
I irrevocably consent to SCWIST and its Representatives and grant to SCWIST and its Representatives the right to collect and use my Content and disclose my Content to any third party (e.g., to the public), including to publish, share, publicize, or otherwise use my Content — including excerpts, quotes, or visuals — on their website, social media platforms, printed materials, campaign-related communications, or in other media, royalty-free.
I understand that my submission may or may not be published and that SCWIST does not guarantee publication, use, or disclosure of my Content. I have no right to review the Content or any material developed using the Content prior to its use, disclosure, or publication.
2. Anonymity and Identification
This campaign allows for anonymous participation. If I choose to include my name, role, affiliation, image, video, likeness, voice, personal information, or other identifying details, I understand that SCWIST or its Representatives may use and disclose that information when using, disclosing, or referencing my Content and may identify me using the same.
I may choose to remain anonymous by not including my personal information or other identifying details.
3. Ownership and Rights
I represent and warrant that I fully own the Content and have full rights to share it and to grant the rights granted in this agreement. No other person or third party holds rights in or to the Content. I represent and warrant that the Content does not contain any untrue or misleading statements and that SCWIST’s exercise of the rights granted in this agreement, including to disclose and publish the Content, do not and will not violate any right of a third party (e.g., intellectual property rights owned by a third party) or any laws. I agree to defend, indemnify, and hold harmless SCWIST and its representatives from and against all claims by third parties resulting from my actual or alleged breach of this agreement or of any of my representations and warranties or arising by SCWIST’s or its representatives’ use or disclosure of my content or exercise of their rights under this agreement.
I hereby grant SCWIST the non-exclusive, perpetual, worldwide, royalty-free, irrevocable right to reproduce, produce, edit, adapt, create derivative works of, display, perform, publish, distribute, and share the Content in whole or in part for educational, awareness, and advocacy purposes related to gender equity and safety in STEM. I irrevocably waive my moral rights in the Content.
4. No Expectations or Promises
I acknowledge that SCWIST has not made any promises, representations, warranties, or commitments regarding the Content. There is no other agreement, written or oral, between myself and SCWIST about the Content. SCWIST may assign or grant its rights under this agreement to a third party. This agreement is binding on our successors and estate.
5. Release of Liability
I FOREVER RELEASE AND DISCHARGE SCWIST AND ITS REPRESENTATIVES FROM LIABILITY UNDER ANY AND ALL CLAIMS, DEMANDS, ACTIONS, OR LIABILITIES ARISING OUT OF OR RELATED TO: THE COLLECTION, USE, DISCLOSURE, PUBLICATION, DISTRIBUTION, REPRODUCTION, CREATION, OR ALTERATION OF THE CONTENT; ANY OTHER MATTER RELATED TO THE CONTENT OR THIS AGREEMENT; SCWIST’S EXERCISE OF ITS RIGHTS UNDER THIS AGREEMENT; AND DEFAMATION OR RIGHTS OF PERSONALITY, PUBLICITY, OR PRIVACY. I HEREBY IRREVOCABLY WAIVE ALL LEGAL AND EQUITABLE RIGHTS RELATING THERETO.
6. Voluntary Participation and Withdrawal
I understand that submitting my Content is voluntary.
If at any time after publication I wish to have my Content removed from SCWIST’s website or social channels, I may contact info@scwist.ca in writing. SCWIST will make best efforts to remove the Content promptly but cannot guarantee removal from third-party or archived sites.
7. Right of Removal
SCWIST reserves the right to remove or edit the Content at any time, without notice, for any reason.
By submitting my story, statement, or pledge, I acknowledge that I have read, understood, and agreed to the terms above.
8. Definitions and Miscellaneous
“Content” includes my story, statement, video, pledge, and any material or content I provide to or for SCWIST or in relation to the #WhatsNext campaign or otherwise; any personal information included in or associated with the Content; and my name, image, likeness, statements, appearance, voice where included in or associated with the Content; and any adaptation or derivative works of my Content.
“Representatives” includes the employees, officers, directors, representatives, volunteers, contractors, and agents of SCWIST.
All matters arising out of or relating to this agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
